Limited Warranty
Maritime Training Services, Inc. (MTS) warrants that the DVD or videotape merchandise furnished is free from defects in materials and faulty workmanship under normal use and service for a period of 90 days after shipment. If a defect is discovered or occurs during normal use and service, purchaser may return the defective merchandise to MTS for replacement. MTS will not replace merchandise damaged by accident, abuse, or misuse.
Purchaser accepts the content of all training programs on an “as is” basis without any warrantee by MTS, either express or implied. MTS makes no representation or warrantee concerning the scope or validity about the content of any training program. MTS disclaims all warrantees of merchantability or fitness for a general or particular purpose and shall in no event be liable for any incidental and/or consequential damages of purchaser.
30-Day 100% Satisfaction Guarantee
If purchaser is not satisfied with the DVD or videotape merchandise, purchaser may simply return the merchandise to MTS within 30 calendar days of receipt and receive a full refund of payment. Purchaser agrees to pay the cost of freight to return any unwanted merchandise.
Prices
All prices are specified in U.S.funds and are subject to change without notice.
Freight Cost and Delivery
Unless otherwise specified, purchaser agrees to pay an extra fee for shipping and handling, which includes the cost of the freight for delivery.
Merchandise shipped by MTS may be carried by the US mail service, air courier, or other method.
Unless otherwise specified, the purchaser should allow 2 to 4 weeks for delivery.
Custom Fee, Import Duties and Taxes
Purchaser agrees that custom fees, import duties and/or taxes, if any, are extra and will be paid by the purchaser upon entry into the destination country.
Pre-Payment and Payment Methods
Pre-payment in US funds is required for all new orders from purchasers who have not established any payment history with MTS.
Pre-payment may be made by bank check (drawn on a bank with a “US Branch of Account”), credit card (American Express, MasterCard, or Visa), or wire transfer.
To pay by credit card, purchaser must fax (+1 206 467 0128) or email a valid card number, card expiration date, and cardholder name. MTS will return a credit card sales receipt for the purchaser’s records.
To pay by wire transfer, purchaser may request bank details by fax or email.
Credit Terms and Late Payment Penalty
Credit terms may be available for existing customers and/or on certain bulk purchases subject to prior approval of purchaser’s credit by MTS. The payment due date is computed by applying the payment terms specified on the MTS invoice to the invoice date. Credit purchases are due in full by the computed payment due date.
Payments not received by the payment due date are late payments. A late payment is subject to a late payment penalty, or finance charge, which accrues at the rate of 1-1/2% per month on any unpaid amount due. At the end of each 30 day period following the payment due date, a late payment penalty will be added to the total amount due. Purchaser agrees to pay in full the invoice total amount plus all late payment penalties which may be added because of purchaser’s failure to pay in a timely manner.
Copyright
The video images and all printed materials produced by MTS are copyrighted and all rights are reserved. The video images and printed materials may not be copied or reproduced in any way without the expressed prior, written permission of MTS. The video images and printed materials are intended for internal use by the purchaser or the purchaser’s company or organization. Use for any reason by any other person, company, or organization is not authorized.
License for Use
Upon receipt of proper payment, MTS grants to the purchaser a non-exclusive license to use the video images and printed materials produced by MTS for internal training and/or other uses consistent with the copyright conditions above. Unauthorized copying or use of the video images or printed materials will void this license and all subsequent use will be unauthorized. In such a case, all video images and printed materials shall be immediately returned to MTS at the purchaser’s expense.
